Overview

Welcome to Retire Ready Texas. The terms “we,” “us,” and “our” refer to Retire Ready Texas.

Retire Ready Texas operates this website and online store, including its information, content, features, tools, products, and related services, to provide customers with a curated shopping experience collectively referred to as the “Services.” Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. They include important information about your legal rights, warranty disclaimers, and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms of Service and our ⁠Privacy Policy. If you do not agree, you should not access or use the Services.

Section 1 — Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence or are using the Services under the supervision and with the permission of a parent or legal guardian.

You may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

We reserve the right to refuse service, suspend accounts, or cancel orders when reasonably necessary to protect Retire Ready Texas, our customers, Shopify, or our service providers from suspected fraud, abuse, unlawful conduct, or violations of these Terms.

Section 2 — Our Products

We make every reasonable effort to accurately display and describe our products. However, colors and product appearance may vary depending on your screen, device settings, lighting, materials, and manufacturing or fulfillment process.

Many Retire Ready Texas products are produced or decorated to order. Minor variations in color, texture, print placement, embroidery, stitching, or other production details may occur and do not necessarily constitute defects.

Product descriptions, prices, availability, and designs may be changed without notice. We reserve the right to discontinue products and limit quantities available to any person, household, geographic region, or jurisdiction.

Nothing in this section limits any rights or warranties that cannot legally be limited or excluded.

Section 3 — Orders, Cancellations, Returns, and Exchanges

Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, limit, or cancel an order for legitimate business reasons, including product unavailability, suspected fraud, pricing or listing errors, payment issues, or shipping restrictions.

We must receive and process payment before an order can be fulfilled. An automated order acknowledgment does not prevent us from subsequently canceling and refunding an order when reasonably necessary.

Please review product selections, sizes, colors, personalization details, billing information, and shipping information carefully before submitting your order. Because many products enter production shortly after an order is placed, changes and cancellations may not be possible once fulfillment begins.

Returns, replacements, exchanges, and refunds are governed by our ⁠Refund Policy. Do not mail a product to Retire Ready Texas or a fulfillment facility unless we have provided return instructions.

Unless expressly authorized by us in writing, products are sold for personal or household use and not for commercial resale or export.

Section 4 — Prices, Payments, and Billing

Prices, discounts, product availability, and promotions may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of material errors.

Unless expressly stated otherwise, displayed prices do not include shipping, handling, taxes, customs duties, or other governmental charges.

Promotions may be subject to additional terms. If promotion-specific terms conflict with these Terms, the promotion-specific terms will govern for that promotion.

You agree to provide accurate and complete payment, billing, shipping, and account information. You represent that:

1. The payment information you provide is accurate and complete.
2. You are authorized to use the selected payment method.
3. Charges incurred will be honored by your payment provider.
4. You will pay all authorized charges, including applicable shipping costs and taxes.

We may use third-party payment processors. Your payment information may be processed by Shopify and other payment providers in accordance with their respective terms and privacy policies.

Section 5 — Shipping and Delivery

Shipping, fulfillment, estimated delivery times, lost-package procedures, and related matters are governed by our ⁠Shipping Policy.

Because many products are made to order, fulfillment time is separate from carrier transit time. Delivery dates are estimates and are not guaranteed.

Orders may arrive in separate packages when products are fulfilled from different facilities. We are not responsible for delays caused by carriers, severe weather, customs processing, incorrect addresses, holidays, labor interruptions, or other circumstances outside our reasonable control.

If we learn that we cannot ship an order within the timeframe promised, we will provide notice and offer the customer the opportunity to accept the delay or cancel the affected order for a refund, as required by applicable law.

Please contact us promptly if tracking shows a problem or an order has not arrived by its estimated delivery date.

Section 6 — Intellectual Property

The Services and their contents—including trademarks, brand marks, trade names, slogans, text, photographs, graphics, product designs, videos, audio, page layouts, and other materials—are owned by or licensed to Retire Ready Texas and are protected by applicable intellectual-property laws.

The Retire Ready Texas name, the RRT Brand Mark, Leave More Than Money™, and associated names, designs, and slogans may not be copied, reproduced, modified, distributed, displayed, sold, licensed, or used without prior written permission from Retire Ready Texas.

These Terms permit you to use the Services solely for personal, lawful, and noncommercial purposes. You may not reproduce, distribute, republish, download, store, transmit, publicly display, create derivative works from, or commercially exploit materials from the Services without prior written authorization.

Nothing in these Terms grants you a license or ownership right in any intellectual property belonging to Retire Ready Texas, Shopify, or another party.

Shopify’s names, logos, products, and service names are trademarks of Shopify. Other names and marks displayed through the Services belong to their respective owners.

All rights not expressly granted are reserved.

Section 7 — Optional Tools

We may provide access to tools, applications, or functionality supplied by third parties. We may not monitor or control those tools.

Third-party tools are provided on an “as is” and “as available” basis, without endorsement or warranties from Retire Ready Texas. Your use of optional third-party tools is at your own discretion and risk and may be governed by additional terms from the applicable provider.

New features, tools, and resources offered through the Services will also be considered part of the Services and subject to these Terms.

Section 8 — Third-Party Links and Services

The Services may contain links to or functionality provided by third parties. We are not responsible for examining or guaranteeing the content, accuracy, security, products, services, or practices of third-party websites.

If you leave our Services to access a third-party website or service, you do so at your own risk. Review the third party’s terms, policies, and practices before completing a transaction or providing information.

Questions or complaints concerning third-party products or services should be directed to the applicable third party.

Section 9 — Relationship With Shopify

Retire Ready Texas is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Retire Ready Texas.

Shopify is not the seller of Retire Ready Texas products and is not responsible for the fulfillment, quality, safety, delivery, return, or use of products purchased from Retire Ready Texas.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising directly from your purchases and transactions with Retire Ready Texas, except where such a release is prohibited by law.

Section 10 — Privacy

Personal information collected through the Services is handled according to our ⁠Privacy Policy. Certain information may also be processed according to ⁠Shopify’s Consumer Privacy Policy.

Because Shopify hosts the Services, Shopify collects and processes information concerning your access to and use of the Services. Information may also be transmitted to service providers and business partners located outside your state or country when necessary to provide the Services.

By using the Services, you acknowledge that you have reviewed the applicable privacy policies.

Section 11 — Feedback, Reviews, and Submissions

If you submit reviews, photographs, ideas, suggestions, feedback, proposals, comments, or other content collectively referred to as “Feedback,” you grant Retire Ready Texas a nonexclusive, worldwide, perpetual, sublicensable, transferable, royalty-free license to use, reproduce, adapt, publish, distribute, display, and promote that Feedback in any medium for lawful business purposes.

You represent that:

1. You own or possess the necessary rights to the Feedback.
2. You have disclosed any compensation or incentive associated with it.
3. The Feedback is accurate to the best of your knowledge.
4. The Feedback does not violate any law or third-party right.

We are not obligated to keep Feedback confidential, compensate you for it, or respond to it.

We may monitor, edit, decline, or remove Feedback that we reasonably believe is unlawful, misleading, abusive, defamatory, obscene, fraudulent, infringing, or otherwise inappropriate.

You may not submit malicious software, use a false identity, misrepresent the source of Feedback, or violate another person’s copyright, trademark, privacy, publicity, or proprietary rights.

Section 12 — Errors, Inaccuracies, and Omissions

Information presented through the Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, availability, shipping charges, transit estimates, or other information.

We reserve the right to correct errors, update information, or cancel and refund affected orders when material information is inaccurate, including after an order has been submitted.

We are not obligated to update information except as required by law.

Section 13 — Prohibited Uses

You may use the Services only for lawful purposes. You may not use the Services to:

1. Violate any applicable law, regulation, or ordinance.
2. Infringe our intellectual property or the rights of another party.
3. Harass, threaten, defame, abuse, impersonate, or harm another person.
4. Submit false, fraudulent, or misleading information.
5. Transmit spam, malware, viruses, or malicious code.
6. Collect or track personal information without authorization.
7. Interfere with the operation, security, or accessibility of the Services.
8. Circumvent security measures, access restrictions, or robot-exclusion measures.
9. Scrape, copy, reproduce, resell, or commercially exploit the Services without authorization.
10. Use automated systems or artificial-intelligence tools except as expressly permitted under Section 14.

We may suspend or terminate access when we reasonably determine that these Terms have been violated.

Section 14 — Automated Agents

This section applies when software or a service takes autonomous or semi-autonomous action on behalf of a person or entity and accesses or interacts with the Services. Such software is referred to as an “Agent.”

An Agent may not access or interact with the Services unless it truthfully identifies itself and complies with these Terms and applicable technical requirements.

Agents must not:

1. Conceal or misrepresent that an interaction originates from software.
2. Mimic human behavior for the purpose of evading detection.
3. Complete or circumvent CAPTCHAs or similar security measures.
4. Evade restrictions intended to control automated access.
5. Continue accessing the Services after being instructed to stop.

Where technically applicable, an Agent must identify itself through its user-agent string using the format Agent/[agent name].

We may restrict or block automated access at any time when necessary to protect the Services, customers, or business operations.

Section 15 — Termination

We may suspend or terminate your account or access to all or part of the Services when reasonably necessary, including when we believe you have violated these Terms, engaged in fraudulent or unlawful conduct, or created a security risk.

You remain responsible for amounts properly owed through the termination date.

Provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, governing law, and other provisions that by their nature should survive will remain effective after termination.

Section 16 — Disclaimer of Warranties

Information made available through the Services is provided for general informational purposes. We do not guarantee that all information will always be complete, current, or error-free.

To the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis, except for express commitments stated in our product descriptions, Refund Policy, Shipping Policy, or other written policies.

We disclaim implied warranties of merchantability, fitness for a particular purpose, durability, title, and noninfringement to the extent those warranties may legally be disclaimed.

We do not guarantee that access to the Services will always be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law. Nothing in these Terms limits consumer rights that cannot legally be waived.

Section 17 — Limitation of Liability

To the fullest extent permitted by law, Retire Ready Texas and its owners, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from your use of the Services or products purchased through the Services.

This includes, without limitation, lost profits, lost revenue, lost savings, lost data, replacement costs, or similar damages, whether based in contract, tort, negligence, strict liability, or another theory, even if advised of the possibility of such damages.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, or other matters for which applicable law prohibits limitation.

Section 18 — Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Retire Ready Texas, Shopify, and their respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable attorneys’ fees arising from:

1. Your material breach of these Terms.
2. Your unlawful use of the Services.
3. Your violation of another party’s rights.
4. Content or Feedback you submit through the Services.

We will provide reasonable notice of an indemnifiable claim. You agree to cooperate with the defense of the claim. We will not agree to a settlement imposing nonmonetary obligations upon you without your reasonable consent.

Section 19 — Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

Section 20 — Waiver and Entire Agreement

Our failure to exercise or enforce a right or provision does not constitute a waiver of that right or provision.

These Terms, together with the policies and operating rules posted through the Services, constitute the entire agreement between you and Retire Ready Texas concerning your use of the Services and supersede prior agreements or communications concerning the same subject matter.

Any ambiguity will be interpreted fairly and not automatically against either party as the drafter.

Section 21 — Assignment

You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent.

We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, change in control, or other lawful business transaction.

Section 22 — Governing Law

These Terms and any separate agreement through which we provide the Services are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, legal proceedings arising from these Terms or the Services must be brought in a state or federal court having jurisdiction over the Texas county in which Retire Ready Texas maintains its principal place of business.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court or exercising rights that cannot legally be waived.

Section headings are included for convenience only and do not limit or otherwise affect these Terms.

Section 24 — Changes to These Terms

The current version of these Terms will be available on this page.

We may update these Terms by posting a revised version through the Services. When required by applicable law, we will provide additional notice of material changes.

Changes become effective on the date stated in the revised Terms. Continued use of the Services after the effective date constitutes acceptance of the revised Terms to the extent permitted by law.
